B. Rights of California Residents

1. Data Subject Requests

California residents have the right to request, twice a year and free of charge, that we disclose certain information about our collection and use of their personal information for the preceding twelve months. Upon our confirmation of a verifiable consumer request, we will disclose to you the following information, as applicable, for the twelve-month period prior to the request:

• the categories of personal Information (as defined by California law) that Plow & Hearth® collected from you;

• Our business or commercial purpose for collecting your personal Information;
• if we disclosed your personal Information to a third party for a business purpose, the personal Information categories that each category of third-party recipient(s) obtained;
• the categories of third parties with whom we share that personal Information; and
• the specific personal Information that we collected about you.

If you are a California resident, you may also request deletion of your personal Information collected or maintained by Plow & Hearth®.

2. How to Make a Request

To make a request, please submit your Data Subject Request, Deletion Request, or Opt-Out ("Do Not Sell My Personal Information") Request via this Webform. You also may contact us via our customer service line at 1-800-494-7544 or email us at info@plowandhearth.com. Once the webform is submitted you may receive an email to the email address you have mentioned and a Plow & Hearth® representative may contact you to request your name, mailing address, and email address from you in order to complete the verification process. We may also request some additional information, such as: last four digits of your credit card, last item ordered, date of last order, total dollar charge of last order, last item you returned, name of person you have shipped to in the past, or a monogram you have placed on a recent order. We will only use the Information we receive for verification. We will not be able to disclose Information if we cannot verify that the person making the Data Subject Request is the person about whom we collected Information, or someone authorized to act on such person’s behalf. Once confirmed Plow & Hearth® will take action on your data subject request or request to delete within 45 days. If more time is needed to respond, Plow & Hearth® will notify you.

Please note that we may not delete your personal Information if it is necessary to:

• complete the transaction for which the personal Information was collected;
• provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
• detect security incidents, protect against malicious, deceptive activity, and take all necessary and appropriate steps to mitigate current and future risk;
• debug and repair internal information technology as necessary;
• undertake internal research for technological development and demonstration;
• exercise free speech, safeguard the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
• comply with the California Electronic Communications Privacy Act;
• engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the Information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
• enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
• comply with an existing legal obligation; or
• otherwise use your personal Information, internally, in a lawful manner that is compatible with the context in which you provided the Information.


3. Do Not Sell my Personal Information

The California Consumer Protection Act gives California residents the right to stop the "sale" of their personal Information through a mechanism called "Do Not Sell My Personal Information" button or hyperlink.

While there are many positive impacts of this requirement, California's definition of "sale" also captures the transfer of data between corporate affiliates (that is, companies that share common ownership) and other transfers that ordinarily may not be thought of as a "sale” in the traditional sense of the word. Because the CCPA has defined some of these transfers as "sales," we may be unable to offer all of our services to our users that ask us not to "sell" their Personal Data.

California residents may utilize the "Do Not Sell My Personal Information" hyperlink located on our Services to facilitate their opt-out of the sale of certain personal Information. However, if you opt to request that we do not "sell" your personal Information you may not be able to use any service we offer that requires our continued use of your email address. 4. Requests from Authorized Agents

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal Information. You may also make a verifiable consumer request on behalf of your minor child. In order to designate an authorized agent, please provide us with written permission granting the authorized agent permission to act on your behalf. Unless you provide power of attorney pursuant to CA Probate Code sections 4000 to 4465, a Plow & Hearth® representative may contact you within 10 business days to confirm your identity.

5. Non-Discrimination

We may not, and will not, treat you differently because you of your Data Subject Request activity. As a result of your Data Subject Request activity, we may not and will not deny goods or services to you, charge different rates for goods or services, provide a different level quality of goods or services, or suggest any of the preceding will occur. However, we can and may charge you a different rate, or provide a different level of quality, if the difference is reasonably related to the value provided by your personal Information.

6. Notice of Financial Incentives

As part of our Services offerings, there may be opportunities to voluntarily provide us with your personal Information. As an incentive for providing using with your Information, you may receive a financial benefit in the form of an email coupon or discount that will be sent to you. This coupon may constitute a financial incentive under the California Consumer Privacy Act ("Financial Incentive"). The categories of personal Information required for us to provide the Financial Incentives include personal identifiers such as contact information, full name, email address, mailing address and telephone number as well as personal and demographic information you choose to provide.

You have the right to withdraw from the Financial Incentive at any time by submitting a request to info@plowandhearth.com. Each Financial Incentive is reasonably related to the value of the personal Information we receive. Please note that if you request deletion of part or all your personal Information, that could affect your ability to qualify for our coupons.

7. Verifying Requests

To help protect your privacy and maintain security, if you request access to or deletion of your personal Information, we will take steps and may require you to provide certain Information to verify your identity before granting you access to your personal Information or complying with your request. In addition, if you ask us to provide you with specific pieces of personal Information, we will require you to sign a declaration under penalty of perjury that you are the consumer whose personal Information is the subject of the request. If you designate an authorized agent to make a request on your behalf, we may require you to provide the authorized agent written permission to do so and to verify your own identity directly with us (as described above).

8. Shine the Light Requests

California Civil Code Section 1798.83 permits you to opt out of the disclosure of your personal Information by XYZ to third parties for the third parties' direct marketing purposes. 9. Additional Information

If you choose to exercise any of your rights under the CCPA, you have the right to not receive discriminatory treatment by us. To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request. X. YOUR CONSENT AND CHANGES TO THIS POLICY

Subject to the above provisions, by using our Services, you consent to the terms of this Privacy Policy and the Terms of Use, of which this policy is a part. We may change our Privacy Policy from time to time as new features or services are added, suggestions from our customers are incorporated or other changes are made. We reserve the right to change, modify or amend this Privacy Policy at any time to reflect changes in our products and service offerings, accommodate new technologies, regulatory requirements, or other purposes.
